FIXED RATE, CONSOLIDATED BILLING

By receiving service from Callective, the customer agrees to be bound by the terms and conditions as set forth in this Terms and Conditions of Service, effective May 1, 2019.

Definitions

1. Residential customer or consumer: a premises at which natural gas is consumed primarily for personal, family or household use.

2. Callective: a natural gas marketing company. Callective buys gas from energy producers and marketers and in turn sells that gas to consumers.

3. Pacific Gas & Electric Company (PG&E): the utility regulated by the CPUC. PG&E distributes natural gas on behalf of Callective and other marketers, maintains the gas pipeline system, and responds to gas leaks and other emergencies.

4. CPUC: California Public Utilities Commission.

5. T&Cs: Callective’s Terms and Conditions of Service as contained in this statement.

I. YOUR PG&E BILL

Although you, the customer, will be purchasing gas from us, we will arrange to have the gas utility send you a single bill for the gas utility’s charges and for our charges. Should you owe any past due amounts on your bill, the gas utility is responsible for collecting them until the gas utility reverses the amounts to us, at which point we will collect them from you directly. If you fail to pay any past due amount owed to the gas utility, the gas utility may then disconnect your service. If you fail to pay any past due amount owed to us, we may transfer your gas service back to the gas utility, who may then disconnect your gas service. If your gas service is disconnected, you may be obligated to pay a disconnect fee to the gas utility. In order to reestablish gas service, you may have to pay a reconnection fee to the gas utility.For information on your gas delivery charges and/or PG&E bill, please contact PG&E directly at 1-800-PGE-5000 or visit their website at www.pge.com.

II. YOUR SERVICE

II-1. Pricing

By agreeing to allow Callective to supply your natural gas procurement needs, you will be charged for gas at the fixed rate of $0.69/therm. Your gas procurement service will be billed by Callective under this plan on a month-to-month basis.

II-2. Term

Callective will supply you with Green-e certified natural gas for a period of 12 months commencing on the first month you receive services from Callective. During this period of time, you will not be permitted to receive services from any third-party core aggregation company similar to Callective. However, if you are unsatisfied with Callective’s services, you will be permitted to cancel services with Callective and purchase natural gas directly from PG&E without penalty.

II-3. Contracts

Callective does not generally require a written contract for gas service. However, when you select service, you are agreeing to remain on the plan for a specified period of time and to keep your account in good standing. See section III-2, “Term” for more information. You have the right to cancel anytime without penalty. If you submit your cancellation at least four days prior to your switch date, your service will not begin with Callective Energy.

II-4. Account and Billing Information

Callective does not generally require a written contract for gas service. However, when you select service, you are agreeing to remain on the plan for a specified period of time and to keep your account in good standing. See section III-2, “Term” for more information. You have the right to cancel anytime without penalty. If you submit your cancellation at least four days prior to your switch date, your service will not begin with Callective Energy.

II-5. Changes to Terms and Conditions

Callective reserves the right to change these T&Cs at any time. Callective will notify you of any changes by written notice in your bill or in a separate mailing.

II-6. Extraordinary Events

If an event occurs that delays or makes it impossible for Callective to perform, such as an act of God, extraordinary weather occurrence, a facility outage on the PG&E or interstate pipeline systems, a PG&E failure to perform, war, civil disturbance, or national emergency, our performance under these T&Cs shall be excused for the duration of such event. Under such conditions, Callective may elect to discontinue service immediately, without notice.

II-7. Limitation of Liability

Callective is not responsible for any losses or damages resulting from any actions/policies associated with PG&E or the interstate pipeline systems, including interruption of service, termination of service, defective service, or operation and maintenance of PG&E’s system or the interstate pipeline systems. Callective is not liable for consequential, exemplary or punitive damages.

II-8. Call Monitoring Policy

Telephone calls to our Customer Care Center may be monitored and/or recorded for quality assurance purposes. All calls for new service are recorded in compliance with CPUC guidelines.

II-9. CPUC COMPLAINT PROCESS

II-10. LOW-INCOME PROGRAMS

Callective Energy currently does not offer any low-income plans. This may change in the future.

Note: Whenever the California Public Utilities Commission enacts new rules prior to the publication of revised Callective Terms and Conditions, those rules will supersede this statement.

In addition, from time to time Callective may introduce new price plans or other programs that require amendments to these Terms and Conditions of Service. In such instances, you will be sent the revisions in advance of their effective date. The revised T&Cs may differ from or supplement this statement and will govern in the event of a conflict with this statement. In some instances, C&I customers may have written agreements with Callective that provide for specific terms of service. In the event of a conflict with these T&Cs, those specific terms will govern.

Why choose? If you are earth conscience and would like to reduce your carbon footprint this is the right plan for you. Callective will purchase carbon offsets on your behalf to offset your gas usage. This makes your business carbon neutral. Callective is Green-e certified.
